Terms of Use

By accessing and using winsta.ai ("the Service"), including our website and our mobile applications for Android and iOS, you accept and agree to be bound by these Terms of Use. The Service is a social media and advertising management platform that may include profiles, feeds, connections, user-generated content, messaging, and AI tools. If you do not agree to these terms, please do not download, install, or use the Service.

Our Privacy Policy explains how we collect, use, and protect your information. By using the Service, you also agree to our Privacy Policy.

Privacy Policy

Winsta.ai provides native mobile applications for Apple iOS (available via the App Store) and for Android (available via Google Play). Your use of our iOS app is also subject to the Apple Media Services Terms and Conditions and the Apple Developer Program License Agreement where applicable. Your use of our Android app is also subject to the Google Play Terms of Service and Google Play Developer Distribution Agreement where applicable. We are solely responsible for our applications and their content; Apple Inc. and Google LLC are not responsible for our apps or their operation.

Permission is granted to use winsta.ai (including our mobile apps and website) for personal and commercial use, including advertising management, social features, and AI tools, in accordance with these Terms and our Community Guidelines. This is a limited, non-exclusive, revocable license, not a transfer of title. Under this license you may not:

• Modify, reverse engineer, or decompile the applications or any part of the Service
• Copy or redistribute the materials except as permitted by the Service
• Use the Service for any illegal or unauthorized purpose
• Remove any copyright, trademark, or other proprietary notices
• Circumvent any access controls, usage limits, or safety measures of the Service
• Use bots, scrapers, or automated means to collect content or user data without our permission

You must be at least 18 years old to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account on any device (including iOS and Android). You agree to provide accurate information and to notify us immediately of any unauthorized use of your account or any other breach of security. One person or legal entity may not maintain more than one account for abusive or misleading purposes, including operating or coordinating multiple accounts to gain an unfair advantage in competitions or to claim rewards in breach of fair play.

The Service may allow you to create profiles, post content, interact with other users (e.g. following, likes, comments), use feeds, and send messages. You retain ownership of content you submit, but you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, modify, display, and distribute your content in connection with operating and providing the Service. We may remove or restrict content that violates these Terms or our Safety Standards without notice. We do not guarantee the accuracy, quality, or safety of any user-generated content; you use it at your own risk.

You agree to follow our Community Guidelines and Safety Standards. You must not use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the intellectual property, privacy, or other rights of others
• Harass, bully, threaten, or intimidate others, or promote violence or self-harm
• Post content that is sexually exploitative, that sexualizes minors, or that constitutes child sexual abuse material (CSAM) or related exploitation
• Impersonate any person or entity, or misrepresent your identity or affiliation
• Spam, phish, or distribute malware or harmful code
• Interfere with or disrupt the Service, servers, or other users' access
• Attempt to gain unauthorized access to any portion of the Service or any other accounts or systems
• Collect or harvest other users' data without their and our consent

We may monitor, review, and remove user-generated content that we believe violates these Terms, our Community Guidelines, or our Safety Standards. We are not obligated to proactively monitor all content on the Service, and we do not guarantee that we will remove any specific content. We may suspend or terminate accounts involved in serious or repeated violations. If you see content or behavior that violates our policies, please use the in-app reporting tools or contact us. We will review reports in accordance with our policies and applicable law.

We accept payments through multiple systems, including Apple Pay and Google Pay, as well as other supported payment methods (e.g. credit/debit cards) where available. In-app purchases and subscriptions on the iOS app are processed by Apple; purchases on the Android app may be processed by Google or other authorized payment processors. Subscriptions may auto-renew unless you cancel before the end of the current period. You can manage and cancel subscriptions via your Apple ID subscription settings (iOS) or Google Play subscription settings (Android). You agree to pay all fees associated with your account. Pricing may vary by platform and region. Refunds for purchases made through the App Store are governed by Apple's refund policy; refunds for purchases made through Google Play are governed by Google's refund policy. For other payment methods, we will handle refund requests in accordance with applicable law and our policy. We reserve the right to change pricing with reasonable notice. Unless otherwise required by law or by Apple/Google policies, fees are generally non-refundable once the service has been provided.

Our Service may include AI-powered tools. AI-generated outputs may be inaccurate, incomplete, or unsuitable for your intended use. You are solely responsible for how you use AI outputs and for verifying their accuracy before relying on them. You must not use AI tools to impersonate any person or entity, commit fraud, or infringe intellectual property or other rights of others. We are not liable for any harm arising from your use of AI features.

To deliver our AI-powered creative features — such as image generation, image-to-image transformation, reference-based image creation, and voice-based content generation — winsta.ai transmits certain user-provided data to third-party AI service providers. By using these features, you acknowledge and consent to the following:

• What data is sent: Images you upload or capture within the app (including reference photos, selfies, and product images) and voice recordings or audio you provide may be sent to third-party AI providers to generate the requested output.
• Who receives the data: Your data is transmitted to AI infrastructure providers (such as cloud-based AI model APIs) that power our generation features. These providers process your data solely to return the requested AI output and are contractually required to protect it.
• Why we send it: The AI models that generate relevant, personalised images and audio outputs run on specialised third-party infrastructure. Without sharing your input data with these services, the core AI generation features cannot function.
• Your control: You choose when to use AI features. No images or voice data are sent to third-party AI services unless you actively initiate an AI generation request. You may decline to use these features at any time.
• Data protection: Third-party AI providers we work with are required to provide the same or equivalent level of data protection as described in our Privacy Policy. Your data is not used by these providers to train their own models without your separate consent.
• Privacy Policy: Full details of what data we collect, how we use it, and which third parties we share it with are set out in our Privacy Policy.

All content, features, and functionality of the Service (including the mobile applications) are owned by winsta.ai and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. User-generated content remains owned by the user subject to the license granted to us in these Terms.

If you believe content on the Service infringes your copyright or other intellectual property rights, please send a written notice to our designated contact. Your notice must include: (1) your full name and contact information; (2) identification of the copyrighted work or IP you claim is infringed; (3) identification of the allegedly infringing content and its location on the Service; (4) a statement that you have a good-faith belief that use of the content is not authorized; (5) a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the rights holder. In no event shall winsta.ai or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption, or arising from user-generated content or conduct of other users) arising out of the use or inability to use the Service. To the extent permitted by law, our liability is limited to the amount you paid for the Service in the twelve (12) months preceding the claim. Apple and Google have no obligation to furnish maintenance or support for the applications.

We may terminate or suspend your account and access to the Service (including on all devices and platforms) immediately, without prior notice or liability, for any reason, including if you breach these Terms or our Community Guidelines or Safety Standards. Upon termination, your right to use the Service ceases. We may retain or delete your content in accordance with our Privacy Policy and applicable law. Provisions that by their nature should survive (e.g. intellectual property, limitation of liability) will survive.

We reserve the right to modify these terms at any time. We will notify users of material changes by updating the "Last updated" date and, where appropriate, through the app or by email. Your continued use of the Service after changes constitutes acceptance of the new terms. If you do not agree, you must stop using the Service.

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which winsta.ai operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in that jurisdiction. For the avoidance of doubt, you agree to submit to the personal jurisdiction of such courts.

Winsta.ai may operate certain features in trial or testing phases from time to time. During any trial or testing period we may not provide winners' prizes for competitions, contests, or similar activities, or we may provide prizes only according to separate rules we publish for that activity. We are continuously improving these features. When prizes or rewards are offered, they may take the form of cash, coins, points, goods, vouchers, or other benefits as we set from time to time. Unless we expressly state otherwise in writing for a specific activity, participation does not guarantee any prize. All points, leaderboards, competitions, rewards, and similar programs are subject to Section 20 (Points, competitions, fair play, and anti-abuse). If our systems reasonably detect multiple accounts operated or coordinated by the same person or entity to enter competitions or claim rewards, we may treat that as abuse: all related accounts may be disqualified, and we may withhold, void, or revoke any pending, testing, or awarded rewards or eligibility.

Winsta AI may offer points, rankings, leaderboards, competitions, contests, challenges, sweepstakes, or similar programs (collectively, "Incentives"). Incentives are intended to reward genuine participation. You must not manipulate or attempt to exploit any Incentive system, including scoring, verification, anti-fraud, or eligibility mechanisms, whether directly or indirectly. Any manipulation or attempt to exploit the points or competition system is strictly prohibited, including (without limitation) deleting and reposting content or duplicating the same or substantially similar content to gain additional points, entries, ranks, or rewards. The following are non-exhaustive examples of prohibited conduct:

• Deleting, archiving, hiding, or removing posts or media and republishing substantially the same or similar content (or otherwise resetting or replaying engagement) to earn extra points, entries, ranks, or rewards
• Posting duplicate, near-duplicate, mirrored, templated, spam, or low-value repetitive content to accumulate points or advantage
• Using multiple accounts, shared credentials, account transfers, identity misrepresentation, or coordinated activity to multiply entries, points, or rewards
• Generating or purchasing fake followers, likes, comments, views, clicks, shares, or other inauthentic engagement to affect Incentive outcomes
• Using bots, scripts, automation, crawlers, emulators, click farms, VPN or device cycling, or any non-human or bulk means to create content, interactions, or sessions
• Exploiting bugs, race conditions, API misuse, payment or refund abuse, chargebacks, or unintended platform behavior to obtain points, eligibility, or prizes
• Collusion, vote rigging, bribery, coordinated reporting abuse, harassment intended to manipulate outcomes, or sabotage of fair participation
• Misrepresenting eligibility, residency, age, tax status, banking or payout details, or identity for verification or prize delivery
• Circumventing technical, policy, geographic, device, rate, or content limits we apply to Incentives

Winsta AI reserves the right to review user activity (including content and edit history, account and device signals, network and behavioral analytics, financial and identity checks, and user reports), investigate suspected abuse or fraud, deduct or recalculate points, void entries or ranks, suspend or terminate accounts, disqualify users from current or future Incentives, and reject, cancel, revoke, claw back, or refuse to deliver any prize or reward (including after winners are announced or a reward was initially shown as approved), where we reasonably suspect or confirm abuse, fraud, misrepresentation, or unfair use. We may require reasonable cooperation and additional verification (including government-issued ID, proof of address, or tax forms); failure to provide timely, accurate information may result in disqualification or forfeiture. We are not obligated to publish internal fraud-detection methods where that would impair security or fairness. Except where mandatory applicable law requires otherwise, all decisions we make in good faith regarding Incentives, eligibility, investigations, and abuse are final.
